As a result of those rulings by the Appellate Division of state Supreme Court, Rudolph Young will serve a sentence of 25 years to life instead of 75 years to life. But the Monroe County Public Defender's Office will seek an appeal of the remaining conviction, saying that such a long sentence is vindictive. Of the two cases considered by the appellate court, the only crime he now stands convicted of is possession of a stolen shotgun. "Right now, he has the same sentence as someone convicted of second-degree murder," said First Assistant Public Defender Brian Shiffrin.

Young, 41, is in state prison. But the Monroe County District Attorney's Office says the sentence is not excessive. "You cannot look at the sentence in isolation," said Second Assistant District Attorney Ken Hyland, who noted that Young has previous felony convictions. Prosecutors argue that Young's criminal past, which includes a 1975 North Carolina murder, makes him a persistent felon, deserving to re- JAMES GOODMAN allowed by the law. Young was acquitted of killing Gregory Root of Brighton in 1991, but he ended up in prison for: 75 years to life on other charges in the two separate cases that were reviewed by the appellate court.

The appellate court yesterday threw out Young's conviction for the burglary and robbery of a Brighton couple in 1991 on grounds that there was no probable cause to arrest Young. Young was arrested after police saw him in a car parked in a Rochester driveway, said Shiffrin. And it's this sentence of 50 years to life that was thrown out by the appellate court. But the court yesterday upheld a conviction of 25 years to life for possession of a stolen shotgun. Young's sentence for the criminal possession charge was at first two to four years, in a case in which he was also convicted of break-ins in Perinton and Pittsford.

But the convictions for Perinton and Pittsford break-ins and shotgun possession were overturned on appeal several years ago. The station plans to use realtime captioning on all of its 6 p.m. newscasts, every day of the week. WHEC-TV (Channel 10) began realtime captioning on Oct. 28. "This is in response to the community," said Chuck Samuels, WOKR news director.

"They've long requested we do this, and we know this is a real need for the community." Real-time captioning allows thousands of profound deaf individuals in the area to read each word as it is spoken, including the weather and sportscasts. Amalgamated Transit Union Local 282 represents about 550 bus drivers and mechanics. Their contract expired Dec. 31. Francis Falzone, the union's business agent and treasurer, said the company's pension offer turned off some union members. Candle starts fire at Brockport pet groomer Several businesses on Main Street in Brockport were closed yesterday after a fire broke out in the Country Pet Grooming Salon, 38 N. Main about 8 a.m. No one was injured, but three cats in the grooming salon died in the fire, which fire officials said started from a lighted candle in the grooming salon. Village Building and Fire Inspector Bill Weber said the damage was confined to the grooming salon, due to fire walls installed between that business and the others that share the building. Robber of three banks sentenced to 11 years A Rochester man who committed three robberies of local banks earlier this year was sentenced to almost 11 years in prison. Willie Lott, 50, was sentenced by U.S. District Judge Michael A. Telesca to 10 years and 10 months in federal prison. He was also ordered to pay $4,130 in restitution.

Lott pleaded guilty in August to robbing the Fleet Bank on East Avenue on March 4. He also admitted robbing Rochester Community Savings Bank branches on Exchange Boulevard on March 6 and in Midtown Plaza on March 7. "The record reflects an individual bent on robbery," said Telesca. Scripps scientist wins local science award Chi-Huey Wong, an MIT-educated scientist at the Scripps Research Institute, is the 1998 recipient of the Harrison Howe Award, presented annually since 1945 the Rochester Section of the American Chemical Society.
