and SUNDAY, SEPTEMBER 13, 2009 DemocratandChronicle.com DEMOCRAT AND CHRONICLE Garcia considers appeal of verdict JAMES GOODMAN STAFF WRITER Frank Garcia, who was convicted last month of murdering a Canandaigua couple on Valentine's Day, has filed a notice of appeal. The notice was sent last week to the appellate division of state Supreme Court and preserves the right of Garcia to file an appeal of his conviction. "I'm sure there will be an appeal," said David Morabito, who submitted the notice for Garcia and represented him at his recent trial in Ontario County Court. Garcia, 35, was sentenced Scout troop marks 90th birthday at Tay House earlier this month to two consecutive life sentences without parole for the Feb. 14 killings of Kimberly and Christopher Glatz.

He' was also sentenced to another 50 years in prison for confining Kimberly Glatz' teenage children against their will during the three hours he terrorized the family. Garcia has been accused of killing two other people and wounding a third outside Lakeside Memorial Hospital in Brockport on Feb. 14. His trial in that case is scheduled for Nov. 9.

Doris donated her body for medical education and research to the Uniformed Services University of Health Sciences. Department of Defense. Doris Louise was born January 15, 1921 in Rochester, New York, the daughter of Harold and Daisy Miller of East Rochester, New York. After graduating from High School in 1938, she attended the University of Rochester and Rochester Business Institute. She worked as a legal secretary until her marriage in 1941 to Marshall Schmitt. They have one daughter, Marsha S. Harris, who lives in Burke, Virginia.

During the 67 years of married life, Doris was a wonderful, loving wife and mother. She was also active volunteer in various organizations. As a member of the First Presbyterian Church of Annandale, she was involved She' many church and social programs. was very interested in helping individuals on the Northern Virginia Hot line; Doris was an active listener for 19 years. Survivors include her husband, Marshall L.

A native of British Columbia, Mr. Sutherland was a US Army veteran of WW Il. He graduated Dartmouth College and New York University. He was a Professor, School of Printing at West Virginia University Institute of Technology, then served as Professor and Director of School of Printing at Rochester Institute of Technology, retiring as Professor Emeritus in 1981. Mr.

Sutherland was active in professional and community organizations, and an early member of the Rochester Curling Club. He is survived by wife Martha Sutherland of Fairhope, son James (Lisa) Sutherland of Rochester, daughter Janet (Timothy) of Simsbury, CT, and granddaughters Susan and Maura. (Ingallina) Rochester, NY: On Tuesday, September 8, 2009 at Monroe Community Hospital at the age of 95 after a long illness. Mary was born in Rochester on March 27, 1914 to Giovanni Lucia Ingallina. She was later married to Ernie Warren and moved to NYC where Ernie played piano with his trio in numerous clubs.

Upon returning to Rochester, she worked in the Monroe County Social Service Building. She raised two boys, Thomas and John on her own, requiring a strength and determination not commonly possessed by women of that day. A devout Catholic, Mary attended St. Cecilia's Church for years. She is survived by her son, Thomas Warren and his wife, Sandy D'Alene of Peabody, MA and John Warren and his wife, Annette Warren of Fairport.

Mary was a loving mother, grandmother, aunt and great-aunt, always encouraging her family to save their money or eat another cannoli. Howard was a devoted husband and dad, so proud of his family. He loved his Faith, Friends and Country. Howard lived his life with a positive, "glass is more than half-full" attitude.

He is a proud Veteran of the United States Navy (Naval Reserve Officer) and served in World War II. Howard is an Aquinas Graduate '45 and a retiree of Eastman Kodak after 33 years as a Purchasing Agent. He will be sadly missed by all who knew him.
